Why the NRCME Program Keeps Running During a Government Shutdown (and What It Means for Medical Examiners)

A partial U.S. government shutdown began on January 31, 2026 when Congress missed the deadline to pass full appropriations legislation. While this lapse affects many federal agencies and programs, not all functions stop - especially those deemed critical for public safety or funded through alternative means. 

One such program is the Federal Motor Carrier Safety Administration (FMCSA), part of the Department of Transportation (DOT). Even though DOT’s funding through annual appropriations has lapsed, FMCSA continues to operate normally because of its unique funding structure. Unlike many agencies that depend solely on year-by-year budget authority, FMCSA has access to alternative funding sources - including authorized contract authority and the Highway Trust Fund - which allow it to maintain essential safety and regulatory activities during a shutdown. 

What This Means for NRCME and Medical Examiners

For healthcare providers involved in the NRCME program, this continuity is important and reassuring:

  • NRCME operations continue: The National Registry remains accessible and functional, and certified medical examiners can continue to perform and report DOT physical exams without disruption.
  • No pause in certification activity: Training, certification testing, and recertification processes continue, ensuring that driver health and highway safety functions remain active.
  • Safety first: Because FMCSA’s mission focuses on commercial motor vehicle safety, these functions are considered essential and funded through contingency mechanisms even when parts of the government are in shutdown status.
